Kübox / TrunkMoves – Terms & Conditions


IMPORTANT NOTICE

When you use the services of Kübox LLC (“Kubox”, “Kübox”, “Trunkmoves”, “we”, “us”), you agree, on behalf of yourself and anyone else with an interest in the shipment, that these Terms & Conditions apply from the time a shipment is prepared, booked, or tendered to a carrier.


1. Nature of Service (Critical Acknowledgment)

By purchasing from Kubox or Trunkmoves, you acknowledge and agree that:

  • Your purchase includes both:
    • Physical containers (Kübox), and
    • Reservation of shipping capacity within third-party carrier networks
  • Kubox operates as a:
    • Packaging provider
    • Technology platform
    • Billing and shipping enablement service
  • Kubox is not a carrier and does not transport goods
  • All transportation services are performed by third-party carriers and governed by their respective terms, tariffs, and conditions

2. Definitions

  • “Shipment” means all goods transported under a single waybill
  • “Carrier” means the transportation provider (e.g., FedEx or other partner)
  • “You” / “Your” means the customer and any party with interest in the shipment
  • “Affiliates” include Kübox, KuboxShips, Trunkmoves, Trünk, and related entities

3. Booking, Capacity Reservation & Final Sale Policy

All purchases made through Kubox and Trunkmoves represent the reservation of space and capacity within carrier networks.

Once an order is:

  • Processed
  • Prepared for shipment
  • Associated with label creation or booking

➡️ The order is final and non-cancellable

This applies regardless of:

  • Whether the shipment has moved
  • Whether the container has been used

Payments are not contingent upon carrier performance, timing, or delivery outcomes


4. Customer Responsibilities

You agree that:

  • You are responsible for:
    • Packing your shipment properly
    • Following all provided packing guidance
    • Seeking professional help if needed
  • You will:
    • Provide accurate shipment details and inventory
    • Declare value of contents
    • Maintain adequate insurance coverage
  • You will:
    • Exclude prohibited items (including food, liquids, hazardous goods)
    • Comply with all carrier rules and regulations
  • You acknowledge:
    • You are using a self-service shipping platform
    • You must create and manage your carrier delivery account
    • You are responsible for printing labels and coordinating pickup

5. Packing and Shipment Preparation

You acknowledge that:

  • All shipments are:
    • Properly packed
    • Suitable for transport through parcel networks
    • Prepared in secure conditions
  • Contents were:
    • In good condition prior to shipment
    • Not concealed or misrepresented
  • Packaging must meet:
    • Carrier requirements
    • Industry standards

6. Documentation & Compliance

You warrant that:

  • All shipment information is:
    • Accurate
    • Complete
    • Compliant with customs and regulatory requirements
  • You are responsible for:
    • Customs documentation
    • Import/export compliance
    • Accuracy of declared values

7. Loss, Damage & Claims

You acknowledge and agree:

  • Kubox is not a carrier and not responsible for transportation
  • All claims for:
    • Loss
    • Damage
    • Delay

➡️ Must be filed directly with the carrier

  • Payment to Kubox is not dependent on claim outcomes

8. Limitation of Liability

To the fullest extent permitted by law:

  • Kubox shall not be liable for:
    • Loss, damage, delay, or misdelivery
    • Carrier actions or failures
  • Kubox’s maximum liability, if any, shall not exceed:
    • $150 USD, or
    • The amount paid for the specific transaction
  • Kubox shall not be liable for:
    • Loss of profits
    • Business interruption
    • Indirect or consequential damages

9. Dangerous Goods

You agree:

  • Not to ship hazardous or dangerous materials
  • To indemnify Kubox against any losses arising from violations

10. Change Fees

The following fees apply:

  • Pickup Change: $75
  • Missed Pickup: $135
  • Label Changes: $75
  • Same-Day Label Creation: $75
  • Delivery Holds / Address Changes: $135
  • Split Delivery: $50
  • International Document Changes: $75 per occurrence

11. Returns and Refunds

All returns are governed by the Kubox Return Policy.

You acknowledge:

  • Unused containers may be eligible for return within 30 days
  • Containers must be:
    • Unused
    • Unassembled
    • In original condition
  • The following are non-refundable:
    • Any order involving reserved shipping capacity
    • Any booked or processed shipment
    • Used containers
    • Custom containers
  • Shipping fees and booking-related charges are non-refundable

12. Refusal of Service

We reserve the right to:

  • Refuse service
  • Cancel orders
  • Limit quantities

At our sole discretion, including suspected fraud or misuse.


13. Third-Party Services

You acknowledge:

  • Carriers operate independently
  • Their terms govern transportation
  • Kubox is not responsible for third-party services

14. Indemnification

You agree to indemnify and hold harmless Kubox from any claims arising from:

  • Your breach of these terms
  • Shipment contents
  • Regulatory violations

15. Governing Law

These Terms are governed by the laws of the United States.


16. Modifications

We may update these Terms at any time.

Continued use of our services constitutes acceptance of updates.
